The owner of the online store Arte.ee (hereinafter referred to as the Online Store) is OÜ MS Productions (registry code 10982613), located at Roo tee 8, 74018 Tallinn, Estonia.
Validity of Sales Contract, Product and Price Information
These terms of sale apply to purchases made from the Online Store. The prices of products sold in the Online Store are indicated next to the products. Prices in the e-store are in euros and include VAT. The price is subject to a fee for product delivery. The cost of product delivery depends on the buyer’s location and the method of delivery. The delivery fee is displayed to the buyer when placing the order. Information about the product is presented in the Online Store directly next to the product.
Placing an Order
To order a product, add the desired items to the shopping cart. If desired, you can change the quantities of products later in the shopping cart as well. To complete the order, you must fill in the required data fields and select a suitable method for product delivery. When ordering via Smartpost or courier, it is important to include a mobile phone number in the data. The amount to be paid is then displayed on the screen, which can be paid via a bank link or other payment solution.
Please note that the e-store also displays out-of-stock products – these cannot be added to the shopping cart. If you are interested in a product that is currently out of stock, please call or send an email to info@martinsaar.com and we can specify the arrival time of the goods.
Submit the order. From this moment, the order is considered submitted. After sending the order, you will receive an Order Confirmation email (if necessary, also check your spam mail catalog).
If you wish to change or clarify something after sending the order, send a notification to info@martinsaar.com
Payment and Payment Methods
The order can be paid for via bank link or bank transfer – please indicate the order number in the explanation. If necessary, we will issue an invoice for the transfer (e.g., for government agencies, etc.) – please note the invoice request in the comments when submitting the order. You have 3 days to pay for the purchase – after that, the warehouse system automatically cancels the order (i.e., after 3 days, we cannot guarantee the availability of the desired products). The contract enters into force from the moment the payable amount is received in the Online Store’s bank account.
Delivery
Goods are sent to the following countries: Estonia, Finland, and by agreement with the customer, also to Latvia and Lithuania. The shipping costs are borne by the buyer, and the relevant price information is displayed next to the shipping method.
If it is not possible to deliver the ordered goods due to the product being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid money (including delivery costs) will be refunded immediately, but no later than 14 days from sending the notification.
Delivery Time
We will ship the order within 3 working days from the receipt of payment. We deliver the goods using SmartPost service, courier service, or Estonian Post package service to the post office or Post24 parcel machine. If you chose to pick up the goods yourself, we will notify you by email when the goods are ready. If you choose the Tartu store as the pickup location, it may take up to one week for the package to arrive.
In winter, with sub-zero temperatures, many products (e.g., paints) are at risk of freeze damage in outdoor parcel machines. In such cases, it is advisable to choose another transport solution. The seller reserves the right to change the appropriate delivery method or extend the delivery time if there is reason to believe that the products may be damaged due to weather conditions.
When the goods have arrived, the postal institution will issue a corresponding notice. The courier will coordinate the delivery time in advance by phone. If the courier is unable to hand over the package (the addressee is not available), the package will be taken to the nearest post office, and you must pick up the package yourself from there.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days. To return the goods, send an application to OÜ MS Productions by email: info@martinsaar.com, which includes the following information:
- Buyer’s first and last name
- Product to be returned
- Invoice number
- Bank account number for refund
The returned product must be unused and in its original packaging. The costs associated with returning the goods are borne by the customer.
The seller will refund the price paid for the goods to the customer immediately, but no later than 14 days from the withdrawal from the order or receipt of the returned goods, to the specified bank account.
The costs of returning the goods are borne by the buyer, except in cases where the reason for the return is that the item to be returned does not correspond to the ordered item (e.g., wrong or defective item).
The buyer must return the goods within 14 days following the submission of the application. The Online Store may refuse to make refunds until it has received the item that was the subject of the contract.
The Online Store is not responsible for defects that have occurred after the goods have been handed over to the buyer. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will replace the defective goods. If it is not possible to replace the goods, the Online Store will refund all fees associated with the sales contract to the buyer.
Dispute Resolution
If the buyer has complaints regarding the Online Store, these must be sent within two months from receiving the order by email to info@martinsaar.com or by calling +37256633133. The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer has the option to turn to the Consumer Disputes Committee. The Consumer Disputes Committee is an independent and impartial unit whose competence is to resolve consumer-initiated consumer disputes arising from contracts between consumers and traders. Turning to the Consumer Disputes Committee and further proceedings are free of charge for the consumer. The Consumer Disputes Committee is located at Endla 10A, 10122 Tallinn, email: avaldus@komisjon.ee, phone: 6201707, website: https://komisjon.ee/et
